Abstract
Life sentences and death sentences are often associated with shootings and many ordinary people are still confused between death sentences and life sentences. Article 12 of the Criminal Code (KUHP) explains that imprisonment is serving a sentence of up to death in prison for a certain time. The shortest time is 1 (one) day and the longest is 15 (fifteen) consecutive years in criminal prison. Law enforcement in Indonesia adheres to 3 (three) pillars, namely certainty, fairness, and benefits. With government policies, it is hoped that the public will comply with existing laws. Research in this journal belongs to the authors included in normative research and with a normative juridical approach to collecting some data to analyze. It can be concluded that this discussion leads to community problems regarding the existence of the death penalty and recently has also been shaken because of a case that shocked the community however, with this policy the granting and delay in the execution of convicts still gets rights which of course are regulated by human rights (human rights). ) in Article 28 of the 1945 Constitution
